【苦勞網】菸測進校園 新北遭批違法侵權

對於強行菸測的違法爭議，新北市教育局校安室主任彭允華表示，菸測是依法行政，依據的是《戒菸教育實施辦法》辦理。此外，則次搬出《菸害防制法》與《學校衛生法》等規定背書。然而，《菸害防制法》第12條規定「未滿十八歲者，不得吸菸」；《學校衛生法》第24條規定「高級中等以下學校，應全面禁菸」；而《戒菸教育實施辦法》第4條則是規定，若違反《菸害防制法》第12條應受戒菸教育，「學校及矯正機關戒菸教育應由各該學校或矯正機關辦理」。綜觀這些條文，皆與學校可實施菸測無關。（閱讀全文）
