銅葉綠素難驗 重罰頂新恐困難

針對頂新檢驗報告，屏東縣衛生局今天下午表示，在送驗的31件油品，扣除調合油不驗外，食品藥物管理署總計驗了11件，由於銅葉綠素尚無法驗出，有關「違法添加」的法條，目前可能還用不上，原先外界估計全案可能有超過3億元的罰款，算一算，目前最高只能罰320萬元。

不過衛生局表示，銅葉綠素有檢驗方法，只是還沒有標準品可以比對，衛生福利部還在努力中，如果可以比對的話，就可以解開難題，找出銅葉綠素，也就可以再依食品衛生管理法的「不實添加」或「惡意添加」的法條重罰業者。

根據檢驗報告，大統提供的純橄欖油脂肪酸比例不符，還有終端產品「健康廚房橄欖油」的脂肪酸比例不符，雖然葡萄籽油的脂肪酸比例符合，但是仍無法去除銅葉綠素的疑慮，因此認為味全的廿一項產品，還是不宜上架。

目前屏東縣衛生局已對頂新第一時間未配合開出300萬元罰款，味全的「健康廚房橄欖油」因為純度不純，與標示不符，會移送台北市衛生局對業者開罰，最高可罰20萬元，至於是否構成詐欺，屏東地檢署正積極偵辦中。
