週刊報導，國民黨主席馬英九以「主席辦公室研究」的名義發函法務部，對特偵組存廢問題做出「利多於弊，不宜廢止」的指示。國民黨發言人楊偉中表示，絕無此事，主席從來沒有以黨主席辦公室名義，向各部會做出任何政策指示，主席辦公室也從未做過任何政策評估研究。

他說，國家政策研究基金會曾針對特偵組存廢做出評估與建議，相關研究報告送黨主席參閱後，由主席辦公室函轉法務部參考。

長期以來，政策會或智庫的政策研究建議，國民黨常態性的函轉各相關部會參考，也僅只於參考，並未作任何指示。
