民法第353條：「出賣人不履行第三百四十八條至第三百五十一條所定之義務者，買受人得依關於債務不履行之規定，行使其權利。」

翌日早上09:00，甲打電話請傢俱公司將沙發改送至丙之住處。經雙方同意的約定買賣行為。

沙發於運送中被撞毀，應屬於尚未完成交貨。

傢俱公司應對甲負擔給付不能之損害賠償責任。未成年店員亦為傢俱公司所託囑代表公司對外行使買賣行為，故要求傢俱公司損害賠償是合理的。
