告邱毅紅包說敗訴 菊籲勿僥倖

(中央社記者王淑芬高雄18日電)前立委邱毅2年前指高市府所屬公務員向企業收紅包，遭市長陳菊求償，最高法院今天判陳菊敗訴定讞。高市府籲邱毅勿存僥倖。

根據法院判決，邱毅於民國101年2月在中天、TVBS的政論節目表示，「陳菊的市政府裡面有一些人，企業若要拜託公文簽快點，很簡單啊，紅包拿來或是稍微招待一下」，「到高雄投資很麻煩，各個關卡很多都給你伸手、刁難」。

陳菊不滿邱毅污衊高市府，提起民事訴訟求償，要邱毅登報道歉。邱毅則舉地勇等案指稱高市府弊案經過媒體報導屬實，他是善意針對可受公評之事進行適當評論。

高雄高分院審理後認為，邱毅指高市府員工涉世運會貪汙案並非不實，他並未故意侵害高市府名譽；他並未針對陳菊個人評論，且陳菊是否盡到對下屬的監督責任，是可受公評之事，因此判決陳菊敗訴。最高法院駁回上訴，全案定讞。

高市府新聞局長丁允恭回應，對此判決結果表示失望，並說邱毅的不實指控已逾越「合理評論」範圍，而去年底邱毅與林瑞圖也因地勇案相關不實指控而被判決有罪，「指蕉為花」的抹黑者們千萬不要心存僥倖。1030718
