被告傷害罪!!急~

就算是互毆
也是雙方都會有刑法277普通傷害罪(或278重傷害罪)的問題
不是這樣簡單結束了

因為相關案件為告訴乃論
朋友傷有多輕重，這部分我看不出來
若刑事責任部分若真的驗出傷是因為此次打架造成
當然也可控告刑事普通傷害罪
但是民事賠償部分可能就要看誰花的醫藥費多
少的要賠給多的
但倘若驗不出傷那就會吃虧

至於怎麼判決
只有本案法官說了算
理論上板大要賠償對方多出來的醫藥費之下
去跟對方談判和解比較好
