集會遊行法違憲，行政院會今（14）日將討論修法，擬明訂「偶發性」集會遊行無須報備，並定義偶發性集會遊行。

大法官會議今年3月作出解釋，認定緊急性及偶發性的室外集會遊行採「許可制」違憲，違反憲法比例原則及保障集會自由意旨，明年元旦起失效。

大法官釋文指出，緊急性集會遊行是指「事起倉卒非即刻舉行無法達到目的之緊急性集會」；偶發性集會遊行指「群眾因特殊原因未經召集自發聚集，事實上無所謂發起人或負責人之偶發性集會、遊行」。

行政院會先前已通過將集會遊行由許可制改為報備制，修正草案先前已送至立法院，但立法院尚未通過。內政部再提修正草案，明確規定偶發性集會遊行無須報備；緊急性集會遊行，則考量占據車道有危險之虞，仍須事先報備。

行政院修法版本送至立法院審議後，也將激起相關集遊規範的討論，例如違法集會不解散之首謀是否去刑化、大小型集會遊行無差別適用恐不符比例原則，執政黨恐不樂見大幅鬆綁，該如何周全這「社會弱勢護身符」，兼顧公共安全，朝野勢必又是一場大戰。
