未獲諒解 葉少二審仍判六年

高雄富少葉冠亨酒駕肇事，造成兩人死亡，今天(7月19日)上午十點二審宣判，葉冠亨被判刑六年。(林憲源報導)

一審判刑六年的葉冠亨不服上訴，高雄高分院二審宣判雖然認為一審援引法條有誤，撤銷原判，但仍認為被告犯行重大，犯後態度不佳，仍舊判刑六年。

高雄高分院行政庭長陳中和說明，被告葉冠亨酒後駕車，以超過120公里的高速行駛，犯罪情形重大，雖然坦承犯行，但造成被害人李幸蓉慘死，李女丈夫傷痛過世，留下一孤女，另外也造成陳大儒痛失愛子陳岡毅，造成兩個家庭破碎，傷痛難以平復。

合議庭認為被告沒有以適當的方法獲取被害人家屬諒解，也沒有賠償損害達成民事和解，而且犯後行為造成被害家屬更加悲痛，因此認定犯後態度不佳，從重判刑六年。

被害人陳岡毅的父親陳大儒則認為二審刑度仍不如家屬預期。

被告葉冠亨是在去年四月間，徹夜狂歡後酒駕，在清晨以時速130公里狂飆，撞上違規左轉的垃圾車後翻覆，撞死清晨運動的女子李幸蓉，也造成同車友人陳岡毅傷重不致。這起案件仍可上訴三審，至於同案被告垃圾車駕駛王家祥，維持一審原判的兩年有期徒刑。
