無號誌交通路口車禍肇責問題(有劃分幹道,支道)

是無號誌十字路口
但有劃分幹道,支道

聽說車鑑定會認為無號誌十字路口無法證明另一車是不是暫停於路口
(有號誌十字路口有紅燈可證明另一車停車於路口)
會各打五十大板

車禍當天
對方無緣無故跨過雙黃線
開到路口的左側

由於他的肇事行為太奇怪,家人懷疑他有講手機or喝酒...
調監視器有拍到他手上拿一個手機,放在耳邊
因為手機沒拍得很清楚
所以他堅絕否認

請問
1.像他這樣跨過雙黃線,侵入到路邊
車鑑會也是各打五十大格嗎?
2.由於當天受害人是停在路邊
監視器死角沒拍到受害人,只拍到肇事者

車鑑會會相信嗎?
還是沒拍到受害人,就不採證受害人的說詞?
