罵人蛇鼠一窩 男判拘役40日

（中央社記者黃意涵台北14日電）周姓男子因故辱罵社區管委會副主委「蛇鼠一窩」遭提告，台灣高等法院依公然侮辱罪判處周男拘役40日，得易科罰金定讞。

根據高院今天公布的判決書，周姓男子是住在基隆市安樂區樂利二街某社區的住戶，他的妻子去年8月間至社區管理中心反映社區事務時，與管委會人員產生嫌隙。

周男隔日前往社區管理中心交誼廳處理妻子的糾紛時，對著副主委的背部辱罵「蛇鼠一窩」，待副主委轉身面對周男後，周男又再罵一次，副主委怒而提告。

判決書指出，周男於檢察事務官詢問時坦承有講「蛇鼠一窩」，但辯稱是在與妻子聊天時，聊到小孩的上課內容，他問妻子如何從字去造詞，講到動物的部分，要用動物造詞，就剛好講到這一句。

法院一審認為，「蛇鼠一窩」意含有壞人互相勾結、沆瀣一氣、狼狽為奸及同流合污之意，依公然侮辱罪判處周男拘役40日，得易科罰金。

高院審理認為，周男謾罵「蛇鼠一窩」，並未指有具體事實，不符善意發表言論的免責事由，因此駁回周男上訴，維持一審判決，全案不可上訴。1020814
