摔落屋頂癱瘓　國三生求國賠敗訴

【綜合報導】台中市五權國中黃姓國三學生，去年1月輔導課結束後，被同學惡作劇鎖在教室後方走廊，黃生翻越女兒牆走在採光罩上想要進入隔壁教室脫困，不料採光罩無法承受重量破裂，黃生跌落地下1樓圖書室的後陽台傷及腦部，致左側肢體偏癱、認知功能障礙等重傷害，向學校請求國賠589萬餘元。

不過台中地院認為，國三學生已具注意並保護自身安全的基本能力，且放學未經家長、老師許可逗留校園，老師宣佈下課後叮嚀關閉門窗離校， 已盡保護與監督的義務，學校設置的女兒牆高度符合規定，且採光罩的設置是要遮風蔽雨，並有張貼「禁止攀爬」等，認定學校無管理缺失等，駁回國賠請求。
