陸軍下士洪仲丘枉死案，軍事檢察系統展開偵辦，卻引起球員兼裁判的質疑。民進黨立法院黨團總召柯建銘今（26）日表示，民進黨團擬修3個法，包括包括國家安全法、軍事審判法、刑事訴訟法，讓軍事審判僅限「戰時」，而法案已提好，今天就要送案子。
柯建銘指出，軍事司法審判基本上已經違憲，國家已有一個司法體系，結果軍事審判又獨立成一個司法體系，國防部既扮演司法院的角色，又扮演法務部的角色，身兼檢察官與法官，審檢合一，違反審檢獨立、司法獨立的問題，所以軍方人權永遠無法解決。
柯建銘表示，這樣違憲的司法體制要打破，所以要修3個法，包括國家安全法、軍事審判法、刑事訴訟法，並切割為平時和戰時。
柯建銘解釋說，「平時」，所有的軍人犯罪，全部移到一般司法檢調系統，由外面的人介入；「戰時」，除非違反陸海空軍刑法的部份，採軍事審判，而其他一般的刑事還是在一般的司法體系，才能徹底解決軍中長期以來，威權體系留下的違憲作法。
至於軍事洩密的部份，柯建銘表示，涉及國家機密，一般刑法也有，民進黨要提修法，國民黨也跟著要提，但不知他們想提什麼。
