偶發性集會遊行擬無須報備

（中央社記者謝佳珍台北13日電）因應大法官會議解釋，行政院會明天將討論集會遊行法修正草案，明訂偶發性集會遊行無須報備，並明確定義偶發性集會遊行。

司法院大法官會議今年3月21日作出釋字第718號解釋，認為集遊法規定緊急性及偶發性的室外集會遊行採「許可制」違憲，違反憲法比例原則及保障集會自由意旨，明年元旦起失效，應由立法者另行修法。

行政院會先前已通過將集會遊行由許可制改為報備制，修正草案已送立法院，但立法院尚未通過。

因應大法官會議解釋，內政部再提集遊法修正草案，明確規定偶發性集會遊行無須報備；偶發性集會遊行是指因特殊原因未經召集而自發聚集，且事實上無發起人或負責人的集會遊行。

行政院會明天將討論集遊法修正草案，通過後將送立法院審議。1030813
