聲請暫緩發監 馬志玲明日出庭

（中央社記者劉世怡台北4日電）元大集團創辦人馬志玲被控背信案遭判刑確定，明天發監執行。馬志玲日前聲請暫緩執行，檢察官待明天詢問後，決定准駁。

元大集團創辦人馬志玲、杜麗莊夫婦被控結構債案件，最高法院6月30日依違反證券交易法判決馬志玲、杜麗莊各7年4月徒刑確定；台北地檢署日前發出傳票給兩人，傳喚他們在8月5日及6日到案發監執行。

檢方上週收到馬志玲夫婦遞狀表示，因身體疾病，聲請暫緩執行，承辦檢察官近日已調查相關事證，明天上午將待馬志玲到案出庭，經詢問後，再行審酌是否有停止執行的事由，再做出准駁。

元大文教基金會人員表示，馬志玲夫婦得知被判刑確定，受到很大打擊，馬志玲明天會在杜麗莊的陪同下，準時到庭，馬志玲現在身體狀況，因年紀大退化又患有失智症，所以只認得杜麗莊，情緒較不穩定，在人多情況下易受驚嚇。1030804
