採光罩漏水

我家露臺的採光罩本身並沒漏水,是樓下鄰居的天花板及外牆滲水(我家露臺的地板是她們家客廳天花板),要求我們家的露臺採光罩要再多出一節雨遮-幫他們擋雨水,否則她們要上法院告我們並要求賠償,我想請問這是我們應該要做的嗎?雨水真的會因為順著採光罩流到外牆然後從她們家的天花板漏水嗎?
不是因為牆壁的材質或因為外牆有裂痕造成雨水滲進去嗎?
如果真的上法院,我們需要賠償她們的損失嗎?這是什麼道理?
如果請土木技師公會鑑定需要多少錢呢?
