立法院6日三讀通過《軍事審判法》修正案，相關人士認為，一般法院對部隊情形不清楚，連要如何蒐集證據都困難。前行政院長謝長廷在廣播節目指出，這都是枝節，在非戰時，軍人和一般民眾都以普通司法來審判，這就是平等，人權也才有保障。
謝長廷表示，立法院相當有效率的三讀通過修改軍事審判法，未來洪仲丘案將移轉司法機關辦理。他說，軍審法是違憲的，軍事審判無法保持司法的獨立性，因為軍法單位都是部隊的單位，易受上級影響。
謝長廷強調，司法獨立的設計是要保障人民，更是憲法的精神，但執政者不談憲法、在野黨也不承認憲法，所以違憲都沒人在乎。
他說，洪仲丘案讓大家重視憲法，在立法院通過軍審法修法後，除了戰時現役軍人才需要受到軍事審判，非戰時犯罪則回歸一般司法機關追訴、審理，所以關於凌虐罪等部分立即生效，其餘修法的部分將在5個月後才生效。
謝長廷表示，這次事件是人民的勝利，當然在野黨的抗爭，以及媒體也發揮一定功用，才能產生這麼大的力量，未來年輕人當兵就比較有保障，這樣的改革、這樣的進步對台灣整體形象有很大的幫助。
謝長廷還說，因為洪仲丘案，有25萬白衫軍走上街頭，在網路上引起大陸網民的關注，大部份大陸網民對於台灣人民的尊嚴與公民的素養都表示相當稱羨。他認為，這就是台灣的驕傲與民主的價值，表現出台灣的精神，相信可以得到國際的尊敬。
